Mediation is a voluntary, ‘without prejudice' process which involves the parties sitting down with a mediator to discuss the issues in order to move towards a settlement. A mediator is impartial; he or she cannot give advice on a best position basis and does not have the power to make a decision or an award, but acts as a facilitator assisting the parties in negotiating a mutually acceptable solution. The parties remain in control of making decisions throughout the process.
